HYF General Competition T&Cs

1. The Promoter and these terms

1.1 The promoter is: Henley Youth Festival, Registered Charity: No 1044280 (HYF).

1.2 By submitting a competition entry, you are agreeing to be bound by these terms and conditions.

2. Competition entries

2.1 Each competition will be open for entries from the launch date to the deadline for entries specified in the relevant competition terms (inclusive) (Closing Date).

2.2 All competition entries must be received by HYF via the entry route specified in the relevant competition terms by no later than the Closing Date. All competition entries received after the Closing Date will be automatically disqualified.

2.3 HYF will not accept:

(a) responsibility for competition entries that are lost, mislaid, damaged or delayed in transit, regardless of cause, including, for example, as a result of any postal failure, equipment failure, technical malfunction, systems, satellite, network, server, computer hardware or software failure of any kind; or

(b) proof of posting or transmission as proof of receipt of entry to the competition.

2.4 If the entrant uses any material or elements in their entry which are subject to the rights of a third party, the entrant must obtain prior to submission of their entry the necessary consents from such party to enable HYF to use and showcase the entry where applicable.

2.5 The competition entries will be judged using the criteria set out in the relevant competition terms. The decision of the judges (acting reasonably) will be final.

3. Eligibility

3.1 The HYF competitions are open to people aged 4-18 who attend/live in the catchment area for one of the following participating schools: Badgemore, Bishopswood, Gillotts, Kidmore End, Nettlebed, Peppard, Sacred Heart, Shiplake, Sonning Common, Trinity, Valley Road OR if you attend Henley College, Shiplake College, Chiltern Edge, Rupert House or St Mary's.

3.2  In entering the competition, you confirm that you are eligible to do so and eligible to claim any prize you may win. HYF may require you to provide proof that you are eligible to enter the competition.

3.3 HYF will not accept competition entries that are:

(a) automatically generated by computer;

(b) completed by third parties or in bulk;

(c) illegible, have been altered, reconstructed, forged or tampered with; or

(d) incomplete.

3.4 HYF reserves all rights to disqualify you if your conduct is contrary to the spirit or intention of the competition. HYF also reserves the right at any time during the competition to remove or disqualify any entry when it believes in its sole discretion that the entrant has: (i) infringed any third party’s copyright; (ii) does not comply with the eligibility and entry guidelines; or (iii) failed to obtain any necessary consents as set out in these terms and conditions.

3.5 Competition entries cannot be returned.

4. The prize

4.1 The prizes (if any) are set out in the relevant competition terms.

4.2 Prizes are subject to availability. There is no cash alternative for the prize and HYF reserves the right to substitute the prize with a prize of equal or greater value.

4.3 Some competition prizes may be supplied by third parties (for example, the Logo Competition prize is provided by the Henley Festival). HYF reserves the right to replace the prize with an alternative prize of equal or higher value if circumstances beyond HYF's control makes it necessary to do so.

4.4 The prize is not negotiable or transferable.

5. Winners

5.1 The decision of the judges nominated by HYF is final and no correspondence or discussion will be entered into.

5.2 HYF will contact winners personally as soon as practicable after the judging of the competition, using the telephone number or email address provided with the competition entry.

5.3 HYF must either publish or make available information that indicates that a valid award took place. To comply with this obligation HYF will publish the surname and county of major prize winners and, if applicable, their winning entries on the HYF Website (https://www.hyf.org.uk/).

5.4 If you object to any or all of your surname, county and winning entry being published or made available, please contact HYF at hyfinfo@gmail.com. In such circumstances, HYF must still provide the information and winning entry to the Advertising Standards Authority on request.

6. Claiming the prize

6.1 HYF will make all reasonable efforts to contact the winner to award the prize personally to them. If the winner cannot be contacted or is not available or has not claimed their prize within 14 days of the judging of the competition, HYF reserves the right to offer the prize to the next eligible entrant selected from the correct entries that were received before the Closing Date.

6.2 HYF does not accept any responsibility if you are not able to take up the prize.

7. Limitation of liability

7.1By entering the competition(s), entrants hereby release and discharge HYF and its organisers, volunteers, committee members, patrons, trustees and subcontractors from and against any and all claims, liabilities, costs, damages and expenses of any kind arising out of or relating to their participation in the competition, their use or acceptance of any prize, the use by HYF of any entries and accompanying material submitted by entrants and/or any actions or decisions of HYF in connection with the conduct and administration of a competition, insofar as is permitted by law.

7.2  Entrants hereby waive any right to seek injunctive or other equitable relief in connection with any claim against HYF, its organisers, volunteers, committee members, patrons, trustees and subcontractors.

7.3 Your statutory rights are not affected.

8. Ownership of competition entries and intellectual property rights

8.1  All competition entries and any accompanying material submitted to HYF will not be returned.

8.2  By submitting your competition entry and any accompanying material, entrants agree that HYF is authorised to display such entries and accompanying material on the HYF website, HYF social media and on any and all other media in connection with the competition including displaying the entries and accompanying material at any of the events during the Henley Youth Festival and afterwards on the HYF website, HYF social media and any other media, whether now known or invented in the future, and in connection with any publicity of the competition.

8.3  By participating in the competition(s), entrants grant permission to HYF to use their names, likenesses, photographs, voices, sounds and/or biographical information in connection with the competition and for any and all advertising, publicity and promotional purposes relating to the competition without additional compensation, unless prohibited by law.

9. Data protection and publicity

9.1 HYF will only process your personal information as set out in the HYF Privacy Policy and as set out in the relevant competition terms. See also condition 8.3, with regard to the announcement of winners.

9.2 The personal data supplied in this application form will only be used for the purposes of administering the HYF event you have applied for, after which, this application form and any records of personal data will be deleted.

9.3 If at any point you change your mind and want to withdraw your consent, please let us know by emailing hyfinfo@gmail.com and we’ll update your details. You also have rights to access your personal data, to have it corrected or deleted, to object to processing and to lodge a complaint with the ICO.

10. General

10.1 If there is any reason to believe that there has been a breach of these terms and conditions, HYF may, at its sole discretion, reserve the right to exclude you from participating in a competition.

10.2 HYF reserves the right to hold void, suspend, cancel, or amend a competition or prize where it becomes necessary to do so, including, without limitation, as a result of the COVID-19 pandemic.

10.3 These terms and conditions shall be governed by English law, and the parties submit to the non-exclusive jurisdiction of the courts of England and Wales.
